These Terms govern your use of Charter Meister (the “Platform”). By using it, you agree to them.
Charter Meister LLC (“we”), a Wyoming limited liability company, operates the Platform. “You” means anyone who uses it — as a visitor, as a renter (“Renter”), or as someone listing a boat (“Owner”).
1. What Charter Meister is
We run a marketplace connecting people who want to rent boats, or join boat tours, with the Owners who list them. We act as an intermediary: the rental agreement is between the Renter and the Owner, and we are not a party to it. We don't own, operate, or control any boat on the Platform.
What we are responsible for is the Platform itself and our intermediary services: showing listings and terms as the Owner gave them, passing requests and messages between the two sides, taking payment and paying Owners, and handling refunds as set out in our Cancellation Policy.
A booking request is a request, not a reservation. The Owner decides whether to accept it, and the agreement between you and the Owner exists only once they confirm. Until then no dates are held for you.
Your dates are secured once the Owner confirms your request, or at once on a boat offered for instant booking. Until then another guest's request may be confirmed first, or the Owner may decline. Once a booking is confirmed, those dates are held for you.
How search results are ranked. Boats and tours are listed in the “Recommended” order unless you choose another. That order is ranked by several factors. The main one is the commission rate the Owner has chosen: Owners who choose a higher rate appear higher. The others are ratings, how complete the listing is, the Owner's booking history and how recently the listing was added. Filters such as dates and location decide which listings appear at all. You can instead sort boats by price, rating or newest, and tours by rating or newest, and then the order follows that choice.
2. Your account
You need to be 18 or over to book. Keep your login details to yourself, tell us if someone else gets hold of them, and give us information that's accurate and current. We can suspend accounts that are compromised or that carry misleading information.
3. Prices
Owners set their own prices. The total shown includes the rental and all mandatory charges; optional extras are added when you select them.
Owners set their prices in the currency shown on their listing, and that is the currency you are charged in. Amounts shown in any other currency are approximate conversions for convenience only. Refunds are made in the currency you were charged.
The security deposit is handled offline. It's shown to you before booking, then paid to the Owner on the spot and returned by them — we never charge, hold, or refund it.
4. Payment
You pay by card through our payment provider, Stripe. We never see or store your full card number.
When you send a booking request, the amount is authorised on your card — reserved, not taken. You are charged only when the Owner confirms. If the Owner declines, you cancel first, or the request isn't answered, the reservation is released.
If a service fee applies, it is shown as its own line before you pay. It is not refunded if you cancel a confirmed booking, but it is refunded in full if the Owner cancels or the booking is never confirmed. Refunds otherwise follow the cancellation terms recorded on your booking (see section 7) and go back to the card you paid with.
Owners are paid through Stripe too, and must complete Stripe's verification before listing a boat or a tour. We keep our commission and pass on the rest 24 hours after the trip starts.
Tours are paid the same way. A tour booking request is authorised on your card and charged when the operator confirms; on a tour offered for instant booking you are charged, and the booking confirmed, when you book. If the operator cancels your confirmed booking or the whole departure, you are refunded in full, service fee included.
5. If you're renting
- Follow maritime law and safety rules wherever the boat operates.
- Stay within the agreed area and time, and don't exceed the boat's stated capacity.
- Return the boat as you found it, fair wear excepted, and report any damage or incident promptly.
- Hold any licence the law requires, unless a skipper is included in the booking.
- Don't use the boat unlawfully or in any way that voids its insurance.
6. If you're listing a boat
- Keep the boat seaworthy, maintained, and legally compliant, with the safety equipment the law requires.
- Hold every licence, registration and permit the law requires to rent out the boat and, where you or your skipper operate it, to operate it. We do not check these for you.
- Hold valid insurance covering the boat and its use by renters.
- Describe the boat accurately — specification, photos, price, availability, restrictions.
- Answer requests promptly, and honour bookings you've confirmed except where safety or genuine force majeure prevents it.
- Handle your own tax obligations on the income.
7. Cancellations
Each Owner sets the cancellation terms for their own listing, and the terms shown to you when you requested a booking are the ones recorded against it — a later change by the Owner doesn't affect a booking already made. Our Cancellation Policy explains how this works and forms part of these Terms.
8. Liability
We are responsible for running the Platform with reasonable care and for the intermediary services described in section 1. We do not promise it will be uninterrupted or error-free.
We are not responsible for the boating experience itself. The rental agreement is between you and the Owner, and we do not inspect, certify or guarantee any boat, skipper or trip: its condition, safety, licensing and insurance are the Owner's responsibility. Damage, injury, or loss during a trip is a matter between those parties and their insurers. Where we are liable to you, our total liability is capped at the fees you paid us in the preceding twelve months.
You agree to cover our reasonable costs if a claim arises from your use of the Platform or your breach of these Terms. Nothing here limits rights you have under consumer protection law that cannot be excluded.
9. Content and privacy
The Platform's own content belongs to us. Content you upload — photos, descriptions — stays yours, but you give us permission to display and distribute it as part of running the Platform.
How we handle your personal data is set out in our Privacy Policy.
10. Prohibited use
You may not use the Platform to:
- give false information, impersonate someone, or list a boat or tour you are not entitled to offer;
- arrange or take payment for a booking outside the Platform to avoid its fees;
- harass, threaten or discriminate against other users;
- post unlawful, misleading or infringing content;
- use stolen or unauthorised payment methods, or attempt fraud or chargeback abuse;
- scrape the Platform, probe or disrupt its security, or interfere with how it works.
We may remove content, cancel bookings, or suspend or close accounts that break these rules.
11. Disputes, governing law and jurisdiction
If you disagree with an Owner or a Renter, talk to them first through the message thread on the booking — most things resolve there. We may help informally, but we're not an arbitrator and any help we give isn't binding.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law principles.
If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, nothing in these Terms deprives you of the protection afforded to you by the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.
12. Changes, termination, and the small print
We may update these Terms; the “last updated” date at the bottom of this page will change and we'll give notice of anything material. Continuing to use the Platform means you accept the update. We may suspend or close accounts that breach these Terms.
If any part of these Terms turns out to be unenforceable, the rest still stands. Not enforcing something once doesn't waive it. These Terms, with the Privacy and Cancellation Policies, are the whole agreement between us. You can't transfer your rights under them without our consent.
